1. Agreement and Scope
The Pittsburgh Cultural Trust (the “Trust”, “we”, “us”, and “our”) operates culturaldistrict.org and other websites, applications, account and checkout systems, ticket-delivery platforms, organization-specific pages, and other digital services operated by or on behalf of the Trust that link to or incorporate these Terms and Conditions (collectively, the “Site”). The Trust operates the Site for the promotion of the Pittsburgh Cultural District and the arts organizations, venues, presenters, and other entities whose events, programs, or services appear on the Site.
These Cultural District Website Terms & Conditions (“Terms”) govern your access to and use of the Site. These Terms do not govern any third party’s separate website unless that website expressly links to or incorporates these Terms.
By accessing or using the Site, creating an account, signing up for communications, or completing a transaction, you agree to these Terms, the Privacy Policy, and any additional terms or policies disclosed for the applicable organization, event, product, or other offering.
If you do not agree, do not use the Site, and do not create an account, sign up for communications, or complete the transaction. You must be legally able to agree to these Terms. If you are a minor, your parent or legal guardian must authorize your use where required.
2. Participating Organizations and Transaction Roles
The Site supports multiple independent organizations other than the Trust, currently including the August Wilson African American Cultural Center, Pittsburgh Ballet Theatre, Pittsburgh Opera, Pittsburgh Symphony Orchestra, Confluence Theater of Pittsburgh, Pittsburgh Arts & Lectures, Pittsburgh Playhouse, and City Theatre, together with other organizations and event partners identified on the Site (collectively, “Participating Organizations”). The list of Participating Organizations may change over time.
The applicable Participating Organization and its role should be identified in the relevant event or product page, receipt, ticket, and/or other transaction materials. For events, programs, products, or services offered by a Participating Organization or other third party, the Trust may act solely as a ticketing, payment-processing, marketing, customer service, or administrative agent.
Unless the Trust is expressly identified as the presenter, seller, or provider, the applicable Participating Organization or other provider is responsible for the event, program, product, or service and for obligations arising from it, including performance, cancellation, refunds, exchanges, credits, and patron claims. To the maximum extent permitted by law, the Trust is not responsible for the acts or omissions of a Participating Organization or other provider or for its failure to provide a refund, credit, exchange, or other remedy.
The Trust’s collection or processing of payment, issuance or delivery of tickets, provision of customer service, or other administrative support does not make the Trust the presenter, producer, promoter, seller, or provider of the underlying event, program, product, or service. Participating Organizations and event partners may set their own prices, fees, delivery methods, and rules and procedures governing transactions and performances. If a conflict exists between these Terms and more specific organization, event, or product terms, the latter controls.
You are responsible for reviewing the terms that apply to your specific transaction. Questions concerning an event or transaction may be referred to the applicable Participating Organization or provider.
3. Accounts and Security
- As conditions of using the Site, you agree to provide accurate information, safeguard your account credentials, and promptly notify us of suspected unauthorized activity. You are responsible for activity conducted through your account to the extent permitted by law. We may require verification or suspend or restrict access if we reasonably suspect fraud, abuse, unauthorized activity, or violation of these Terms.
4. Acceptable Use
You may use the services only for lawful personal or authorized business purposes. You may not:
- Use bots, scripts, scrapers, automated purchasing tools, ticket-buying software, or other automated means except as expressly authorized.
- Circumvent queues, security controls, purchase limits, presale restrictions, access codes, geographic restrictions, authentication, or rate limits.
- Interfere with service operation; probe or exploit vulnerabilities; introduce malicious code; or attempt unauthorized access.
- Use false, misleading, stolen, or unauthorized identity, account, payment, address, email, or telephone information.
- Purchase tickets primarily for unauthorized resale, speculative listing, or commercial distribution contrary to event policies or law.
- Copy, reproduce, frame, mirror, republish, or commercially exploit service content without permission.
- Use the services to harass, threaten, defraud, impersonate, infringe rights, or engage in unlawful conduct.
5. Ticket Prices, Fees, and Orders
5.1 Prices and Fees
The total price displayed for a live-event ticket will include mandatory fees and charges required to purchase the ticket, excluding taxes, shipping charges, and optional products or services that you select, as permitted by applicable law. Unless specifically stated otherwise, listed prices are in U.S. dollars.
The applicable Participating Organization determines the base price and may determine or authorize applicable fees, discounts, and inventory rules. Taxes, shipping, and optional add-ons will be disclosed before you complete the transaction. Prices, fees, discounts, availability, and seat inventory may change before an order is completed.
Ticket prices may vary based on demand, availability, promotions, discounts, or other factors. A purchaser is not entitled to a refund or credit because the same or comparable tickets are later offered or sold at a different price.
A price or description error does not obligate us or an event organization to fulfill an order at an incorrect price. If an error is identified after purchase, we may cancel and refund the affected item or offer the opportunity to purchase at the correct price, subject to applicable law.
5.2 Order Submission and Acceptance
Submitting an order is an offer to purchase from the seller identified for the transaction. An on-screen acknowledgment or authorization hold does not necessarily mean the order has been accepted. An order is accepted when the transaction is confirmed and tickets or other products are issued, unless applicable law provides otherwise. The Site operator, seller, or applicable Participating Organization may reject or cancel an order before or after confirmation for reasons including inventory error, pricing error, payment failure, suspected fraud, purchase-limit violation, event restriction, or technical malfunction. If a paid order is cancelled, the responsible seller will provide an appropriate refund unless withholding is permitted by law.
If you do not receive an order confirmation or experience an error or interruption after submitting payment information, you are responsible for confirming the status of the transaction before submitting another order. We are not responsible for duplicate purchases resulting from a purchaser's failure to confirm whether an order was completed.
5.3 Availability and Seating
Ticket availability is not guaranteed until an order is completed. Seat maps and views are illustrative and may not represent exact sightlines, dimensions, equipment, staging, railings, temporary obstructions, or nearby patrons. “Best available” and automated seat selection depend on current inventory and system rules.
6. Payment
You authorize the merchant of record identified for the transaction, together with its payment processors and service providers, to charge the payment method submitted for the total amount shown at checkout. The merchant of record may be the Pittsburgh Cultural Trust, Cultural District, a Participating Organization, or another disclosed provider. You represent that you are authorized to use the payment method and that the billing information is accurate. Payment methods and digital wallets may be added, restricted, or removed at any time.
A payment authorization may appear before final settlement. Your bank or provider controls holds and posting time. If a payment fails, is reversed, or is disputed, we may cancel associated tickets, benefits, memberships, gift cards, donations, or other products to the extent permitted by law. Contact us promptly before initiating a chargeback so that we can investigate and attempt to resolve the issue; however, nothing in these Terms limits non-waivable dispute rights under applicable law or card-network rules.
7. Ticket Delivery and Use
Tickets may be delivered digitally, by mail, at will-call, or through another method identified at purchase. Delivery dates for mailed tickets are estimates. You are responsible for providing accurate delivery information, satisfying applicable technical and identification requirements, and timely accessing and presenting your tickets.
Failure to receive, download, transfer, or present a ticket does not automatically entitle you to a refund if the ticket was made available through the selected delivery method or an alternate delivery method selected by the Trust. Lost, stolen, duplicated, transferred, or compromised tickets may be replaced or reissued at the discretion of the applicable organization and may require verification. Ticket transfers may be restricted or unavailable.
Tickets may not be used for advertising, promotions, contests, sweepstakes, giveaways, fundraising, or other commercial purposes without the prior written authorization of the applicable presenter or event organization.
8. Refunds, Exchanges, Cancellations, and Changes
8.1 General Rule
Except as stated in an applicable event, Participating Organization, subscription, membership, box office, or other transaction-specific policy, ticket purchases are final and nonrefundable. The organization identified as the presenter, seller, merchant of record, or provider for the applicable transaction is responsible for determining whether any refund, exchange, credit, donation of ticket value, or other remedy is available, subject to applicable law. Any such remedy may be subject to deadlines, availability, fees, eligibility requirements, and the applicable organization’s policies.
No refund, exchange, credit, or other compensation is provided for a missed performance, late arrival, failure to use a ticket, inability to access or present a ticket after it has been made available through the selected delivery method, or removal from an event for violation of applicable policies, except as expressly provided by the applicable organization or required by law.
8.2 Cancelled Events
If an event is cancelled and not rescheduled, the applicable presenting or selling organization will determine the available remedy, if any, and any applicable request deadline, subject to applicable law. Where the Trust is not the presenter, seller, merchant of record, or provider, the Trust may assist with communications, processing, or customer service, but the applicable organization remains responsible for determining and funding any refund, credit, exchange, or other remedy.
Unless expressly stated otherwise, refunds or credits apply only to the ticket price and those fees the applicable organization determines are refundable, and do not include separately purchased parking, delivery charges, donations, insurance or refund protection, merchandise, travel, lodging, or other incidental or third-party expenses.
8.3 Postponed, Rescheduled, Relocated, or Materially Changed Events
Tickets may remain valid for a postponed, rescheduled, relocated, or materially changed event. The applicable presenting or selling organization will determine whether refunds, exchanges, credits, or other remedies are available and any request deadline, subject to applicable law. Changes in cast, artist, program, supporting acts, performance time, venue configuration, entry procedures, or seat location do not automatically entitle a purchaser to a refund unless the applicable organization states otherwise or law requires it.
8.4 Force Majeure
Neither the Trust nor an applicable Participating Organization will be responsible for delay, interruption, relocation, rescheduling, modification, or cancellation caused by circumstances beyond its reasonable control, subject to any remedies required by applicable law or expressly provided under the applicable event or transaction policy.
9. Ticket Limits, Resale, and Fraud
Events may impose ticket limits using reasonable criteria. Orders exceeding or attempting to circumvent those limits may be cancelled without notice, including orders placed through multiple accounts or identities.
Reselling of tickets above face value is prohibited and considered unauthorized resale.
Tickets obtained from unauthorized sellers, speculative listings, or third parties may be invalid, duplicated, cancelled, priced above face value, or ineligible for support, refunds, exchanges, replacement, or venue communications. We are not responsible for unauthorized resale transactions.
We may review, delay, restrict, cancel, or require verification of orders or accounts in instances of suspected fraud, unauthorized resale, automated purchasing, policy circumvention, or other abuse. We may void affected tickets and cooperate with payment providers, event organizations, venues, resale platforms, and law enforcement as permitted by law.
10. Venue and Event Rules
Admission is subject to the ticket, event, and venue rules. These may include security screening; rules regarding bags, cameras, recording, food, beverage, smoking, weapons, and other prohibited items; age restrictions; dress or conduct standards; late-seating and re-entry restrictions; and health or safety requirements. Refusal to comply may result in denied admission or removal without refund to the extent permitted by law.
A ticket is a revocable license permitting the holder to attend the specified event from the designated seat or area, subject to these Terms and all applicable event and venue policies. The applicable venue, presenter, or event organization may, to the extent permitted by law, refuse admission, remove a patron, revoke ticket privileges, or cancel tickets without refund for violation of these Terms or applicable policies; fraud or misuse of tickets; conduct that is unlawful, disruptive, abusive, threatening, unsafe, or interferes with the enjoyment of other patrons; or failure to comply with reasonable instructions of venue personnel.
The venue, presenter, or event organization may also relocate a patron to another seat or area for operational, production, accessibility, safety, security, or other reasonable purposes.
By entering an event or venue, you acknowledge that photography, audio recording, and video recording may occur. To the extent permitted by law, you grant the applicable event organization, venue, presenter, and their designees permission to photograph, record, and use your image, likeness, voice, and appearance as captured at or in connection with the event for archival, documentary, news, promotional, advertising, and other lawful business purposes, in any media, without further notice or compensation.
11. Accessibility
We seek to provide accessible purchasing and attendance experiences. Contact the applicable Participating Organization or venue for accessible seating, companion seating, assistive services, or accommodations. Accessible inventory and policies may vary by venue and event. Misrepresentation or misuse of accessible seating may result in relocation or cancellation where permitted by law.
12. Donations, Memberships, Subscriptions, and Gift Instruments
Donations are generally irrevocable and nonrefundable unless the applicable organization approves otherwise or law requires a refund. Tax deductibility depends on applicable law and any goods or benefits received. Restricted gifts are subject to acceptance by the recipient organization.
Memberships, subscriptions, and related benefits, and gift certificates, gift cards, vouchers, account credits, and similar programs are subject to the terms disclosed for the applicable program or instrument and applicable law. You may cancel future renewals using the disclosed method; cancellation does not necessarily refund a current term.
13. Parking and Third-Party Add-ons
Parking, refund protection, ticket insurance, dining, merchandise, transportation, and other add-ons may be sold by a Participating Organization or independent third party and may be governed by separate terms. The applicable seller or provider is responsible for availability, fulfillment, claims, refunds, and support as disclosed during purchase. A refund or credit for an event ticket does not automatically apply to a separately provided add-on.
14. Privacy Policy and Third-Party Services
Our Privacy Policy is incorporated into these Terms and explains our collection, use, disclosure, and protection of personal information.
The Privacy Policy and these Terms do not control the privacy practices of independent third-party websites or services that may be linked from or integrated with the Site, including payment, parking, insurance, refund-protection, social media, digital wallet, streaming, or partner organization services. Those providers may have their own privacy notices and terms.
15. Communications
We and the applicable Participating Organizations and service providers may use the contact information you provide to send transactional, service, legal, and other communications relating to your account or relationship with us. Marketing communications are subject to applicable consent requirements and opt-out rights. Opting out of marketing does not prevent necessary transactional or service communications.
16. Intellectual Property
The Site and its content - including text, graphics, logos, trademarks, photographs, video, audio, software, designs, seat maps, and compilations - are owned by or licensed to the Trust, one or more Participating Organizations, or other content owners and are protected by law. Subject to these Terms, you receive a limited, revocable, nonexclusive, nontransferable right to use the Site for personal, lawful purposes. No other rights are granted.
You may not use names, logos, marks, photographs, recordings, program materials, or other protected content without permission from the applicable owner, except as allowed by law.
17. Disclaimers and Assumption of Risk
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION, INVENTORY, PRICES, SEAT MAPS, OR RESULTS WILL ALWAYS BE COMPLETE OR ACCURATE.
These disclaimers do not limit warranties or rights that cannot lawfully be disclaimed.
Attendance at live events involves ordinary risks associated with crowds, movement through public spaces, lighting and sound effects, weather, and other conditions inherent in live events. By attending, you voluntarily assume those ordinary and reasonably foreseeable risks, except to the extent liability cannot lawfully be waived or limited.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE TRUST, THE APPLICABLE PARTICIPATING ORGANIZATION, NOR THEIR AFFILIATES, VENUES, PRESENTERS, PRODUCERS, PROMOTERS, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE, AN EVENT, A TRANSACTION, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF EACH ENTITY SUBJECT TO THESE TERMS WILL NOT EXCEED THE AMOUNT PAID TO THAT ENTITY FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM. FOR A CLAIM AGAINST THE TRUST THAT IS UNRELATED TO A PAID TRANSACTION WITH THE TRUST, THE TRUST'S AGGREGATE LIABILITY WILL NOT EXCEED $100.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the Trust and the applicable Participating Organizations, together with their affiliates, officers, directors, employees, and agents, from third-party claims, damages, and reasonable costs arising from your unlawful use of the Site, your material violation of these Terms, or your infringement of another person’s rights.
20. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where another jurisdiction’s law must apply. Subject to any non-waivable right to bring a claim elsewhere and any organization-specific dispute terms disclosed for a transaction, the state and federal courts located in Allegheny County, Pennsylvania will have exclusive jurisdiction over disputes arising from these Terms or the Site, and the parties consent to those courts.
Before filing a claim, you and we agree to make a reasonable good-faith effort to resolve the dispute by contacting the other party and describing the issue and requested resolution. This informal resolution requirement does not prevent either party from seeking urgent injunctive relief or meeting a legal filing deadline.
21. Changes and General Terms
The Effective Date of these Terms and Conditions is set forth at the top of this webpage. We reserve the right to change our Terms and Conditions as business needs require. Updated Terms will be posted with a revised date. Material changes will receive additional notice where required and will apply prospectively unless law permits otherwise. Terms in effect when a transaction is completed generally govern that transaction, together with applicable event-specific policies.
We may suspend or terminate access to services for a material violation, security concern, fraud, abuse, legal requirement, or discontinuation of a service. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers, limitations, dispute provisions, and remedies.
If a provision is held to be unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with an organizational restructuring, transfer of operations, or similar transaction. These Terms and incorporated policies constitute the agreement regarding their subject matter and do not create third-party beneficiary rights except where expressly stated.

23. SMS Terms and Conditions
The Trust, Participating Organizations, and authorized service providers offer mobile messaging programs, which you agree to use and participate in subject to these SMS Marketing Terms and Conditions (the “SMS Terms”). These SMS Terms supplement the Terms and Condition above and apply to any text message program operated by or on behalf of the Pittsburgh Cultural Trust or a Participating Organization that links to or incorporates these SMS Terms (“Program”). If there is a conflict between these SMS Terms and the general Terms, these SMS Terms control only with respect to SMS/MMS messaging.
User Opt In
Program allows users to receive SMS/MMS mobile messages or other marketing and informational communications by opting into the Program, such as through online or application-based enrollment forms or by texting a keyword to one of our phone numbers (such as a traditional 10-digit phone number or a toll-free number) or “short codes” (a 5 or 6-digit number that We use to exchange SMS/MMS with you), to which you may need to respond to confirm your opt-in. Regardless of the opt-in method you used to join the Program, you agree that these Terms apply to your participation in the Program. By participating in the Program, you agree to receive text messages, including automated text messages, at the phone number associated with your opt-in, and you understand that consent to these terms is not required to make any purchase from us. While you consent to receive messages and calls sent using an autodialer, this shall not be interpreted to suggest or imply that any of Our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”), and you and we agree that the system we use to send our messages is not an ATDS.
User Opt Out
If you do not wish to continue participating in the Program or no longer agree to these Terms, you agree to reply STOP, UNSUBSCRIBE, REMOVE, CANCEL, END, QUIT, OPT OUT or ARRET to any mobile message from us to opt out of the Program. You may receive one additional mobile message confirming your decision to opt out. You understand and agree that these opt-out options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, is not a reasonable means of opting out.
Support Instructions
For support regarding the Program, text “HELP” in reply to the message you received from us, or send us an email at contact@trustarts.org. For further opt-out support, please contact our SMS platform provider, SlickText, at support@slicktext.com.
Cost and Frequency
Although we do not charge you for our messages, message and data rates may apply from your wireless carrier. The Program involves recurring mobile messages, which may vary in frequency based on, among other factors, your level of interaction with us.
MMS Disclosure
The Program will attempt to send SMS MTs (terminating messages) if your mobile device does not support MMS messaging.
Our Disclaimer of Warranty
The Program is offered on an “as-is” basis and may not be always available in all areas and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. T-Mobile is not liable for delayed or undelivered mobile messages.
Participant Requirements
You must have a wireless device of your own, capable of two-way messaging, be using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.
SMS Privacy Policy
We respect your privacy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. We will use information you provide to transmit your mobile messages and respond to you, if necessary. This includes, but is not limited to, sharing information with platform providers, phone companies, any companies who engage us to promote their goods and services to you, and other vendors who assist us in the delivery of mobile messages. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect Our rights or property.
When you complete forms online or otherwise provide us information in connection with the Program, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in our sole discretion, we believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Program for an ulterior purpose, We may refuse you access to the Program and pursue any appropriate legal remedies. This Privacy Policy is strictly limited to the Program and has no effect on any other privacy policy(ies) that may govern the relationship between you and us in other contexts.
